he was either sending or receiving a text message, his attorney said Monday.
Kindle's attorney, Brian Roark, said Kindle lost control of the car on June 24 while looking at the message. "It was probably something he should not have been doing," Roark said. The crash caused about $8,700 damage and no one inside was hurt. After the crash, Kindle pushed the car back into the street and went home. He was checked by team doctors and told he had a concussion but did not have to be hospitalized. University spokesman John Bianco said Kindle told his coaches about the accident the next morning. "We're glad nobody else was hurt and he's going to be fine," Bianco said. Police Cpl. Scott Perry said police are still investigating but no charges have been filed. Perry said police have not talked to Kindle or Roark. Because Kindle hit a stationary object and did not injure anyone else, he is only required to file a report with the Texas Department of Transportation, Roark said, adding he planned to file it as early as Monday. Roark said Kindle would pay for the damages himself or through insurance if it is covered. Kindle, a senior from Dallas, had 10 sacks last season. Brian Roark is a helluva good attorney. He was with David Minton's Firm until he went out on his own. He came from the Travis County DA"s office where
he prosecuted DWI offenses.
In February 2006, I was arrested for DWI and I retained Brian. The charge was reduced to a speeding ticket, and has been expunged from my record, which cost me an additional $1,500over and above Brian's fee. I drink, but don't have a dsrinking problem, and have not had so much as a speeding ticket (except that one) in probably ten years. I suspect Brian represented Sergio in the DUI, and that's why he was called for this one, but that doesn't mean a goddamed thing! When I was Sergio's age, I drank like a fish and drove drunk many times. Sergio has never been convicted of driving while intoxicated, so any assertions to the effect that he has a drinking problem are reactionary bullshit, not to mention totally unfounded. Other than Dr. Rudy, who is admittedly an alcoholic in remission, can any of the other people on this thread that are jumping the kid's ass tell me that they have never gotten behind the wheel with a BAC that would currenlty qualify them as drunk? As to him being a dumbass for texting while driving, that's a superfluous comment that doesn't mean shit, since that is not a crime. I try not to do it, but I do once in a while. It ain't the smartest or safest thing to do, but like I said, it isn't illegal. Mack will most likely take some action against him for no other reason that he is supposed to be a team leader, which we will sorely need this year. He and Ken Rucker (and Coach Boom, I imagine), will remind Sergio of this in some very special way, I expect.

Booray, I don't know if he has a drinking problem or not. I guarantee you that if he does, those close to him already know it. I pray to God he doesn't
have a problem with alcohol, cause it's a bitch eventually getting your life straightened out if you do. The long and the short of it is that if he has a
drinking problem, we'll all likely know about it eventually.

Doc, I guess that was my point. None of has any evidence that he does. This and a DUI ain't enough, but there seem to be those on this thread who have
jumped to that conclusion, rather unfairly, IMO. I don't know if you did or not, but at least one poster did, and also characterized him as a dumbass for
texting and driving. As I said, it may not make him the brightest bulb in the room, but it isn't illegal, anymore than applying makeup via a rear view
mirror on the drive into the office, which has been going on since they fucked up and let women drive.
As I stated and Paso and Booley and others did, his coaches understand that he fucked up, and that he needs to be a better leader than this. I have absolutely no doubt that he will get that message clearly. If he gets some sort of suspension, fine. I would think that will be the least of his worries while he's picking schrapnel out of his ass from Boom's response, both verbal and physical.

I think texting while driving is one of the great underreported stories going on in America right now. It HAS TO be the cause of a lot of wrecks like this one.
I only started texting a lot about 6-8 months ago and I learned real quick that texting while driving is a really bad idea - every bit as bad (or worse) than
driving drunk.

I bet you it's as it says it was. Ya'll keep trying to turn him into an alcoholic (which I hope he is not) but most college kids text. I doubt they
recognize each other's voices at this point, but if you've ever texted while driving, it's way easy to swerve, run into something, etc. that's
why it is illegal here. It's worse than drunk driving actually because you are less engaged with the road. And as for the drinking, let's cut him some
slack. All of us probably did way worse in college and I betcha there are posters on this board who got pinched as well.
Fat, drunk and stupid is no way to go through life son...
